What about "..are Open Source, and legally dist..."? "That are" followed
by "which are" sounds funny (to me) when I say it.

I agree, but, the GPL is worded similarly. I think that's where the
original author(s) of this waiver (
www.vlug.org) got their wording.

I think the original idea behind the installer's name on the waiver is
if a problem does arise, we would know who to talk to to get it
resolved. It's not so much a signature lie as it is a place for the host
to write in the installers name.
