IANAL!

There seems to be some confusion about Ex Post Facto laws and the
constitution.  All the interpretations I've read basically say you
cannot prosecute someone for something that was previously legal that
they did, that is now illegal.  This in no way prohibits the
government from making previously illegal acts legal and letting
people (or in this case corporate entities) off the hook.  Examples
would be the various generalized amnesty bills for illegal aliens and
the repeal of prohibition.
