I believe that the build environment you have is not an issue.
Have you cross verified the use of devfs/udev between the 2 kernels?
If the dev for the controlling tty/pty is not available to 2.6.9 due
to it's using udev rather than devfs, then create the controlling
tty/pty via a udev alias.
