If it expires, it expires.  One no longer owns any interest in 
it.  So?

HOWEVER: As to prospective acquirers of an expired domain 
(i.e., as a customer of 'TDNAM'), it would seen that a duty of 
loyalty, not to 'poach' nor to favor one customer over another 
except according to a previously agreed scheme, seems pretty 
obvious.

This response from them seems apropos:

"Go Daddy has reviewed the auction and found nothing improper.

Adam Dicker's knowledge on the auction was no different from 
what any customer coming to our TDNAM site would have had.

To ensure customer confidence and to avoid any possible future 
questions of impropriety all GD employees are now and in the 
future prohibited from participating in TDNAM auctions, 
purchasing, sales & back orders."
