You shouldn't have any problems at all as long as you're using file-level tools (cp, tar, etc.). Using something like dd would be bad because that operates at the physical disk layer and not the file layer.

I would like to copy my home partition from my old box that is formatted 
as ext2 to a new box that will be ext3. Should I expect any problems?
