Correct me if I am wrong, but doesn't the vendor agree to the OEM license?  
If I go buy a laptop with Windows XP today, I won't see a license agreement 
when I turn the system on.

On the other hand, I have a feeling that the laptop will come with little 
slips of paper with the EULA on there.  I might not see them, but that is 
because I never made a reasonable attempt to read the paperwork.  It would 
be a reasonably weak argument in court to claim I was never informed of the 
agreement.
