I believe that civil suits are our responsibility - they drive the legislative process and provide for change.

Heck, I even take on landlords, illegal actions from parking enforcement, and think in terms of YouTube or Podcasting events that create that terrible feeling that I am living in communist Russia.

Interestingly enough the 6th Amendment is about criminal violations as is the 5th.

In Arizona almost every traffic violation is a civil offense.  It has been years since I have dealt with this stuff, however if the court issues a criminal warrant based on a civil traffic violation then I'm thinking this must open the 6th Amendment to due process.

The government can't just put fines on you without some recourse.  Sounds like a nice law suit.  Problem is us common folk do not have the resources.  This is a place where the lawyers should put in some free time and effort into changing the system for the common good.

And include traffic violations?

In Oregon, people end up with thousands of dollars of traffic violations on their records, often discovering years after they moved.  There just is no way to fight it.  No rules enforced for notification for a ticket that can amount to between $30.00 and $350.00.

Interesting read.  In 1981 I was certified on doppler traffic radar.  In 1984 I attended a class the verified I was able to verify speed within a reasonable tolerance.  During the time the operators experience was far more important than the radar unit.  The radar unit was a verification.

I think there needs to be a class action law suit to take down the traffic radar and to make restitution to those ticketed.  If speeding is an issue bring in the uniforms and the undercover traffic units.

Also I'm thinking there must be a 6 or 14 amendment due process violation if you are given a ticket and a collection agency send you a notice to pay up.
