As for it not seeing the right variable name, it depends on where it is being executed from. If you have the code you posted below in your index.phppage then it is a problem. However I think that the actual page you are accessing is probably something for a framework. Which your index.php is being included instead of parse in place. The reason the footer works is that the footer include call is contained within the initial index.php page. I hope this helps..
