I agree that the actual subject of the article linked has something to do with Linux, in that it affects various projects having to do with recording broadcast television. However, I fail to see what the article has to do with activist judges. In every context I have heard the term used, until now, it has been in reference to judges making up entitlements or classifications or what-have-you that didn't exist before. In this context it was applied to judges interpreting the Federal Communications Commission's authority in regards to the broadcast flag. The term activist judges is generally used derogatorily applied when one disagrees with their decision. I fail to see how striking down the broadcast flag is A Bad Thing for Linux or F/OSS in general. At any rate, I suppose I've rambled enough...
