I've actually been wondering that one myself.  Would the fed be willing
to chalk up a loss on purpose to help get a law struck down that their
own people didn't agree with.  Since Adobe has officially backed out of
supporting prosecution, could the prosecutors get away with doing less
than their best to further an alternative goal?
